Manager/Senior Manager - Mortgage Legal - Construction Finance Business

Job Overview

The primary function of the mortgage legal team is to review the title of the various collateral which is offered as security for our mortgage based businesses. The team is responsible to manage all legal risks associated with the mortgage businesses and advice on mitigating such risks while finding structured legal solutions to do business in an efficient manner within the parameters of applicable law. The candidate will have to carry out all such matters assigned by the reporting manager.

Key Roles & Responsibilities

Business Requirement:

- Reviewing and finalizing title diligences for construction finance business.

- Review and approve title search reports for only such properties offered as security which is acceptable as per company policy and which is legally enforceable;

- Empanelling and liasoning with external lawyers for finalizing TSIRs;

- Drafting, reviewing and standardizing loan, security documents and all non-standard document;

- Drafting legal policies and processes pertaining to various classes of collateral accepted in various market segments and regions;

- Coordinating with the credit team and risk team on a case to case basis;

- Identify and highlight relevant enforcement risks to the senior management with respect to all cases;

- Clarifying legal queries raised in title search reports;

- Provide documentation support i.e. vetting, drafting, modifications of the agreements, notices, petitions, etc;

- Build strong relationship with advocates, regulatory/statutory authorities;

- Build capability at branch level to improve productivity;

- Improve TAT for TSIRs;

Ancillary:

- Conduct knowledge management sessions for the various businesses and the legal team;

- MIS management and managing audits;

- Strengthening and streamlining processes;

- Ensure adherence to culture with focus on Integrity, Discipline, Teamwork (no silos);-

Experience Required (In Years):

- Graduate/ Post Graduate with minimum 8 Years of experience handling projects with sound knowledge of core lending and peripheral systems & Processes.

- Should have understanding of title diligence for collaterals in Delhi NCR amongst other states in North for retail mortgage business with NBFCs and HFCs;

- Should have excellent understanding of process and regulations governing NBFCs and HFCs;

- Should have excellent understanding of transfer of property and land laws;

- Should have excellent understanding of RBI and SEBI regulations;

- Should be an individual contributor;

- Should be able to work in a diversified team and take responsibility of the profile being handled.
