1. Legal intervention in Business Development:

- Assist the Land Acquisition team in evaluation of land records and conduct thorough due diligence for all deals and transactions.

- Highlight concern areas/gaps and recommend risk mitigation strategies / options.

- Ensure timely review and finalization of the documents (MOU, Joint Development Agreement, Lease Deed, Sales Deed, Space Sharing Agreement, Agreement to Sell, Agreement to Build etc.) from a legal perspective through General Counsel, ensuring minimal risks for the Organization.

2. RERA:

- RERA Documentation and Other related regulatory compliances.

- 3 Legal assistance for Project Financing

- Oversee the mutation of land records, Non encumbrance certificates and other legal requirements.

4. Customer Assistance:

- Preparation of final application form, Agreement, Lease document, Allotment letters, Collaboration docs, etc., other correspondences in compliance with the provisions of RERA and other Consumer Acts, to be executed with customers.

- Reply to the query of various customers, brands and RWA's.

5. Drafting and Vetting:

- Drafting and vetting of Agreements, Deeds, BBA, Possession letters, notices, MOU's, etc.

6. Liason:

- Liason with Govt. regulatory

7. Litigation:

- Consumer Litigation

- To oversee various cases in Consumer Forums, Civil Courts, Arbitrator, State Commissions, NCDRC, DRT, RERA, High Courts (about 20 Courts/Authorities) in about 15 locations.

- Institutional Litigation

- To oversee various cases to protect the legal interest of Group Companies and handle matters with NCLT, NGT, Enforcement Directorate, PMLA Court etc.

8. Preparation/Review of Legal Cases and Legal Notices

Legal Cases:

- Coordinate with external advocates to finalize pleadings to be filed before the relevant courts and provide necessary guidance to Managers to present the evidence before the court.

- Ensure representation of the Organization for all Court Hearings.

- Oversee the progress of all litigations in different Courts and solicit periodic updates on the same.

Legal Notices/Show Cause Notices/Criminal Complaints/ etc.

- Ensure timely response to legal notices received from Courts; coordinate with external Legal Councils/Firms for validation of response to minimize risks.

- Ensure timely reply to the Criminal Complaints to various police stations, EOW and other Government Agencies.

9. Compliances

Deals in the cases on matter of Labor Litigation, Industrial Dispute, BOCW, CESS, Minimum Wage, Payment of Bonus Act, Gratuity, PF, etc.

10. Guidance for Corporate Governance

Governance and Risk Mitigation

- Set-up processes and guidelines for ensuring high level of governance and minimize risks for the Organization.

- Ensure standardization of Legal practices across the Organization.

- Lead the development of a mechanism to check and counter check adherence to legal compliances across all the Departments.

- Keep abreast of changes in the regulatory framework, legal formalities and compliances pertaining to the Real Estate industry.

- Ensure adherence to all legal compliances as specified by laws/bodies as may be applicable.

11. Reports

- Analysis of all the Court Cases and Litigation & prioritize the matter in line with Business gravity

- Ensure timely preparation and submission of MIS/status updates on litigation related activities.

- Ensure adherence to established Department SOPs, policies and guidelines.

- Ensure adherence to SAP reporting requirements and guidelines.

- Contribute to the Knowledge Management initiatives of the Department.
