JOB SUMMARY: Litigation & Dispute Resolution This is a consultant role , initially will be a 12 months contract- extendable basis the business requirement. KEY RESPONSIBILITIES: a. Strategic driving of litigation matters pertaining to the assigned areas of responsibility within and outside India with complete understanding of the matter on facts and in Law. b. Briefing Senior Advocates, external counsels and attending all hearings in courts as authorized representative of the company. c. Maintain all case files related to ongoing legal proceedings and keep them updated at all times. d. Draft / review plaints, written statements, petitions, counters affidavits, complaints etc. Carryout requisite legal/case law research, liaise with external counsels & internal clients, follow-up with external counsels on regular basis. e. Update the litigation management tool and keep the internal clients abreast of the key developments. f. Draft the replies to the show cause notices/legal notices that would be served on the company or to be sent by the company. g. Draft/vet the agreements relating to one or more of these functions in order to ensure that the rights of the company are well protected, risks/exposures are clearly identified and prevented/minimized/brought on to the table before finalization of the agreement h. Draft the representations to various authorities ventilating the grievances of the company. i. Identify risks and work towards risk mitigation. j. Attend hearings before the enforcement agencies on behalf of the company, as and when required. k. Proactive partnership with cross functions to minimize the incidents exposing the company to commercial and penal risks. l. Prepare the list of pending cases/issues and keep them updated at all times. m. Provide periodic reports to cross functional teams, as would be required from time to time. INTERACTIONS: INTERNALLY : The role involves extensive interactions with cross functional teams in supporting their needs. The incumbent should develop good interpersonal relationship with the client departments in order to get the best information and insights from them. The incumbent should collaborate with the legal team members and should seek their support without any hesitation, wherever required. EXTERNALLY : Advocates, Consultants, Government officials. Educational Qualification LL.B. / LL.M. Post qualification experience Consultant - Litigation 9- 10 years Relevant Experience Commercial Litigation & Dispute Resolution Relevant Industry :Legal Desirable/Good to have: Desirable experience Some in-house experience is desirable but not a must have FUNCTIONAL COMPETENCIES: - Proficiency in all basic laws viz., Constitutional law, Administrative law, Civil and Criminal Procedural laws. - Proficiency in Food Safety Laws, Legal Metrology Laws, Consumer Laws, Negotiable Instruments Act, Arbitration, Specific Relief Act & Intellectual Property Laws - Working knowledge in Industrial and Labour laws. BEHAVIOURAL SKILLS (Both essential & desirable): An ability to effectively (concisely and engagingly) communicate legal concepts and advice Exceptional interpersonal and leadership skills and demonstrated ability to function well in a multi-disciplinary team environment Self-motivated and able to deal effectively with strategic issues as well as tactical operational details Must exercise sound judgment, be able to work independently and efficiently under time pressure and deadlines in a face-paced environment Self-starter that is effective in driving change throughout the business and gaining stakeholder buy-in
