Position Overview:
- We are seeking a highly experienced and meticulous General Manager - Contracts to lead the contracts function from the corporate office.
- Reporting directly to the Managing Director, this role is critical for safeguarding the company's contractual interests across all projects.
- The ideal candidate will handle end-to-end contract management, from pre-execution review to dispute resolution and foreclosure.
- This position requires deep expertise in contract law, arbitration, and infrastructure project management, along with strong coordination capabilities across project heads and senior management.
Key Responsibilities:
Contract & LOA Review.
- Thoroughly review all draft Letters of Acceptance (LOA) and Contract Agreements.
- Identify and mitigate discrepancies, risks, or unfavorable obligations prior to execution; ensure reviews are completed within a 2-day timeline.
Dispute Resolution & Arbitration.
- Act as the central point of contact for ongoing contractual issues, liaising with Project Directors and HODs.
- Develop and finalize strategic approaches and draft official correspondence for resolving contractual disputes.
- Oversee and vet all draft Conciliation Minutes and Arbitration documents before execution.
Supplementary Agreements.
- Coordinate with project teams to obtain and evaluate all draft Supplementary Agreements.
- Ensure required modifications are made to protect the company's interests.
- Contractual Compliance (Authority & Sub-Contractor).
- Coordinate with site teams to resolve and close contractual issues with both the Authority (Change of Scope, Extension of Time) and Sub-Contractors.
- Review main contract agreements, work orders, and historical correspondence to draft effective contractual and technical letters for site teams.
Project Foreclosure:
- Monitor projects for critical issues that may cause delays or stagnation.
- Conduct site visits to assess the severity of issues and determine their resolvability.
- Initiate and manage the foreclosure procedure for projects that reach a point of stagnation, ensuring full contractual compliance.
Required Qualifications & Skills:
- Education: Bachelor's degree in Civil Engineering, Quantity Surveying, or Law (LLB).
- A postgraduate degree in Construction Management or Contract Law is highly preferred.
- Experience: 15+ years of progressive experience in contract management within infrastructure or heavy civil construction (roads, railways, bridges).
Expertise:
- Deep understanding of Indian contract law, arbitration, and conciliation.
- Proven experience handling Change of Scope (COS), Extension of Time (EOT), and dispute resolution.
- Experience managing both Authority-facing and sub-contractor agreements.
