Summary:
The Lead Non-Litigation (Real Estate) plays a pivotal role in supporting the legal function by ensuring robust compliance, accurate documentation, and seamless transaction execution across Maharashtra, with a focused emphasis on the MMRDA region. This position is critical in managing end-to-end real estate due diligence, contract lifecycle management, regulatory compliance (including RERA), and cross-functional coordination. The ideal candidate will be a seasoned legal professional with deep expertise in real estate law, transaction structuring, and property documentation, capable of thriving in a fast-paced, transaction-driven environment. Their work directly enables the organization to mitigate legal risks, ensure regulatory adherence, and facilitate timely project delivery.
Responsibilities:
- Draft, review, and vet a wide range of legal documents including sale agreements, development agreements, lease deeds, leave and license agreements, MoUs, NDAs, vendor contracts, and other transactional instruments.
- Develop and maintain standardized templates for customer agreements, ensuring alignment with current laws, including RERA compliance.
- Conduct thorough due diligence on land and property titles, including verification of 7/12 extracts, mutation entries, RTCs, khata extracts, and encumbrance certificates.
- Coordinate with internal and external legal teams to execute title searches, issue legal opinions, and resolve title-related concerns.
- Ensure accuracy and completeness of documentation for land acquisition, joint ventures, and project development initiatives.
- Review debt-related real estate documents such as mortgage deeds, debenture trust deeds, loan agreements, and hypothecation deeds from a legal and risk mitigation perspective.
- Support RERA registration processes and ongoing compliance, including timely filings and documentation.
- Maintain up-to-date records of title clearances, legal approvals, and compliance status.
- Execute and register agreements at sub-registrar offices and ensure proper documentation of all registration-related activities.
- Establish and manage a centralized digital and physical repository for legal documents, with tracking systems for renewals, obligations, and deadlines.
- Collaborate closely with Sales, Projects, CRM, and Finance teams to provide timely legal inputs, resolve queries, and support closure of commercial transactions.
- Liaise with municipal authorities, consultants, and regulatory bodies to secure necessary approvals and compliance documentation.
Requirements:
- LLB from a recognized university; additional certifications in real estate law or contract management are advantageous.
- 5-8 years of hands-on experience in non-litigation legal roles within the real estate or infrastructure sector.
- Proven expertise in real estate transaction structuring, due diligence, property documentation, and compliance with RERA and other regulatory frameworks.
- Strong command of property laws, stamp duty, registration laws, and municipal regulations in Maharashtra.
- Excellent drafting, negotiation, and communication skills with attention to detail.
- Proficiency in MS Office and document management systems.
- Fluency in both Marathi and English (written and spoken).
