Job Description :
Objective : Direct/indirect tax compliance, specifically focusing on GST, TDS, RERA compliance, and tax audits for property developments. They ensure accurate tax provisioning, handle tax litigation, and optimize tax structures for projects within the organization and its Special Purpose Vehicles (SPVs). The role requires ensuring timely completion and accuracy in tax audits, statutory filings, and adherence to all regulatory requirements.
Responsibilities :
Key Responsibilities :
1. Financial Accounting & Compliance :
- Ensure adherence to all statutory compliances, including TDS, GST, and Income Tax.
- Complete Tax Audit and other statutory audits within prescribed timelines.
- Maintain accuracy in all accounting transactions and ensure reliability of financial information.
2. Taxation & Statutory Matters :
- End-to-End Compliance : Manage GST filings including GSTR-1, GSTR-3B, and annual returns like GSTR-9/9C for all projects.
- Input Tax Credit (ITC) : Reconcile GSTR-2B with internal books to resolve vendor mismatches. This is critical in real estate due to restrictive ITC rules under Sections 17(5)(c) and (d) of the CGST Act.
- Sector-Specific Advisory : Advise on GST implications for Joint Development Agreements (JDA), Transfer of Development Rights (TDR), and works contract services.
- Reverse Charge Mechanism (RCM) : Ensure compliance with RCM, especially when procurement from registered suppliers falls below the mandatory 80% threshold.
- Direct Taxation (Income Tax & TDS) : Overseeing Income Tax Return (ITR) filings, tax audits, and advance tax computations. Ensuring correct TDS deduction under sections like 194C (contractors), 194J (professionals), and 194I (rent).
- Litigation & Assessments : Representing the company before tax authorities for scrutinies, appeals, and hearings. Drafting responses to notices from the Income Tax or GST departments.
- Strategic Advisory : Providing tax opinions on joint development agreements (JDA), project feasibility, Tax Planning, and structuring mergers or acquisitions.
- Statutory Compliance : Maintaining a compliance calendar to ensure zero penalties or non-compliance across multiple Special Purpose Vehicles (SPVs)
3. Strategic & Advisory Support :
- Assist in strategic tax planning and optimization in line with business objectives.
- Provide inputs on tax-efficient structures and compliance risk mitigation.
- Support management in critical decision-making by providing accurate and updated financial and tax data.
- Contribute to continuous process improvement in accounting, taxation, and compliance systems.
- Timely and accurate filing of all statutory returns and reports.
- Completion of audits (Tax, Statutory, Internal) within timelines.
- Maintenance of zero non-compliance record with statutory authorities.
- Proactive communication and coordination with tax consultants, auditors, and regulatory bodies.
Qualifications and skill-sets :
1. CA qualified with minimum 5 - 8 years of post-qualification experience in Taxation, preferably in the Real Estate.
2. In-depth knowledge of Direct & Indirect Taxation (Income Tax, GST, TDS).
3. Sound understanding of GST and Income Tax laws and other statutory compliances.
4. Proficiency in SAP / ERP systems and MS Office tools.
5. Strong analytical, problem-solving, and interpersonal skills.
6. Excellent coordination and communication abilities with internal and external stakeholders.
7. High integrity, attention to detail, and result-oriented mindset.
