Role Overview:
- The Head of Legal will lead Kaabil Finance's entire legal function across office and field operations, with primary responsibility for litigation management, legal recovery of NPAs, and enforcement of security interests. This role owns the legal strategy for stressed and litigated accounts, balancing recovery outcomes with cost efficiency, timelines, and regulatory compliance.
- The position requires a hands-on legal expert with deep practical knowledge of enforcement laws and the ability to lead and drive results through legal and collection teams on the ground.
Key Responsibilities:
1. Legal Strategy for Recovery & Litigation:
- Formulate and execute the overall legal recovery strategy for NPAs and litigated accounts.
- Decide the appropriate legal route (pre-litigation, NI proceedings, SARFAESI action, civil or criminal remedies) based on recoverability, timelines, and cost-benefit analysis.
- Drive time-bound resolution of stressed accounts through structured legal action.
2. Enforcement & Execution Expertise:
- Lead end-to-end execution under Negotiable Instruments Act (Section 138) and SARFAESI Act (including possession, auction, and enforcement processes)
- Ensure proper drafting, filing, follow-up, and closure of legal cases.
- Closely monitor on-ground execution, coordination with advocates, authorities, and vendors to avoid procedural lapses or delays.
3. Legal Team Leadership (Office & Field):
- Lead and manage a multi-layer legal team including In-house legal officers, Field legal executives and Empanelled advocates and recovery vendors
- Set clear performance metrics, accountability frameworks, and review mechanisms.
- Build strong coordination between legal, collections, and business teams.
4. NPA Portfolio & Litigation Management:
- Maintain centralized control and visibility over Litigated loan portfolio, Stage-wise legal actions and Recovery status
- Track effectiveness of legal actions and continuously refine strategies
- Identify bottlenecks and take corrective action to improve resolution timelines.
5. Cost Management & Recovery Efficiency:
- Drive legal recoveries with a strong focus on cost optimization.
- Evaluate and control legal expenses including advocate fees, court costs, and enforcement expenses.
- Ensure legal actions are commercially viable and aligned with recovery potential.
6. Compliance, Governance & Risk Control:
- Ensure all legal actions comply with RBI guidelines, statutory requirements, and internal policies.
- Minimize legal risk, adverse judgments, and reputational exposure.
- Support audits, inspections, and regulatory reviews related to legal and recovery matters.
7. MIS, Reporting & Management Updates:
- Develop and present robust MIS
- Provide regular updates to senior management on legal risks and recovery performance.
Experience & Qualifications:
- 5+ years of post-qualification experience in NBFCs, Banks, ARCs, or Financial Institutions.
- Proven expertise in NI Act (Section 138) and SARFAESI Act, with demonstrated on-ground execution experience.
- Prior experience leading legal and recovery teams across multiple locations.
- Law degree (LLB) mandatory.
