Key Responsibilities
As a Real Estate Lawyer, your responsibilities will include, but are not limited to:
- Real Estate (Regulation and Development) Act (RERA): Providing expert legal advice and ensuring compliance with RERA regulations for various real estate projects.
This includes drafting and reviewing RERA-compliant agreements, handling RERA registrations, and representing clients before RERA authorities.
- Transfer of Property Act, 1882: Advising on and drafting documents related to the transfer of property, including sale deeds, gift deeds, mortgage deeds, leases, and agreements to sell.
Ensuring adherence to the provisions of the Transfer of Property Act.
- Indian Contract Act, 1872: Drafting, reviewing, and negotiating a wide range of contracts pertinent to real estate transactions, such as development agreements, joint venture agreements, construction contracts, and service agreements, ensuring their enforceability and compliance with contract law.
- Consumer Protection Act, 2019: Representing clients in consumer disputes related to real estate, including advising on consumer rights, drafting responses to consumer complaints, and appearing before Consumer Forums/Commissions.
- State-Specific Rules and Regulations: Staying abreast of and ensuring compliance with various state-specific real estate laws, land revenue codes, stamp duty acts, registration acts, and municipal bye-laws relevant to the locations of practice (Mumbai, Pune, Bangalore, Chennai).
- Due Diligence: Conducting comprehensive legal due diligence for land acquisitions, property transactions, and development projects, identifying and mitigating legal risks.
- Litigation & Dispute Resolution: Managing and resolving real estate disputes, including title disputes, eviction matters, property encroachments, and contractual breaches, through litigation, arbitration, or mediation.
- Documentation & Drafting: Preparing, reviewing, and finalizing a variety of legal documents, including opinions, notices, affidavits, petitions, and appeals related to real estate matters.
- Client Management: Effectively communicating with clients, understanding their needs, and providing strategic legal counsel.
- Regulatory Compliance: Ensuring all real estate transactions and projects adhere to environmental laws, zoning regulations, and other relevant statutory requirements.
Qualifications
- Educational Background: Bachelor of Laws (LLB) degree from a recognized university.
