Assistant Vice President/Senior Manager - Resolution - BFS - LLB/LLM

Qualification : LLB / LLM (Mandatory)

Exp : 8 to 10 years

Location : Mumbai only

Looking for candidates from ARC only.

JOB DESCRIPTION:

- Evaluating NPA accounts by taking Physical possession, sale of property as per SARFAESI guidelines.

- Issuing 13(2) notices under SARFAESI Act 2002 and U/s 101 final notices to borrower & guarantor.

- Responsible for overall debt control, recoveries and collections of NPAs. Responsible for conducting auction proceedings for sale of secured assets under SARFAESI Act, finding the buyers/investors for the property.

- Issuance of Notices/Replies to notices.

- Responsible for framing collection strategies and its implementation in line with company objectives.

- Compliance of ARC related prudential guidelines prescribed by RBI.

- Making strategic planning for action under SARFAESI Act - from initial Notice, handling objections and taking the cases to possessions/ foreclosure; taking up cases before DRT and filing suits where required for possession and recovery of properties in all eligible delinquent cases in Mortgages.

- Sale of Assets through DRT process under Recovery Proceedings.

- Drafting and vetting of legal documentation and ensure legal compliances are adhered.

- Prepare various drafts for filing under various Act's like DRT, NCLT.

What we look for:

- Litigation exposure is desirable.

- Must have relevant experience in SARFAESI Act, IBC, NCLT etc. rules and regulations

- Experience of handling NPA cases in ARC/Banking/NBFC/Financial Institutions
