Position Title: Manager - Indirect Tax  Reports To: Associate Director (Taxation)  Basic Purpose Of the positions:  The role is responsible for  1. Ensuring compliance to various indirect taxes (Central Excise/ Service Tax/ Entry Tax/ Works Contract/ Entry Tax/ LBT etc.) at the Plant/ Sales Branches/ Corporate  2. Handling Distributors VAT Classification Case across India thereby reducing Double Taxation  3. Representing before the CTO/JC (E) level for PVMI & its Distributors  4. Litigations Management till Tribunal/CESTAT Level by way of tracking all cases and drafting appeals, documentation etc.  5. Analysis and Identification of possible avenues for tax savings through tax planning.  6. Efficiently managing Contingent Liabilities, Provisions, LMS and submitting the reports to the management.  7. Preparation for GST implementation  Principal Accountabilities:   Central Excise in Plants & Service Tax in Plants, Branches & Corporate:  - Provide guidance and support to Plants & Branches on the CERA/CAG/Service Tax Audits and follow up and close the audit queries  - Imparting/Updating/Implementing/Reviewing the provisions of Excise & Service Tax Laws. Informing the same to the plant & branch teams on regular intervals to enable them to comply with the requirements.  - Advising on CENVAT provisions, Classifications & Valuations, Negative List provisions, Reverse Charge Mechanisms, Works Contract provisions of Service Tax etc.  - Ensuring the Export Refund Filings and its follow ups  - Interpreting the Opinions & Views and providing clear guidelines to the Plant & Branch team on the new transactions / activities.  - Visiting Plants and Branches at regular intervals and conducting due diligence reviews on Excise & Service Tax  - Periodical review & scrutiny of Forms, Returns and documents being maintained by the Branches & Plants  - Ensuring EWH Excise Compliances.  - Involved in GST Implementation.  VAT, CST & Entry Tax:  - Availing all applicable VAT/CST/Entry Tax benefits in respective states like ITC and concessional forms  - Ensuring proper VAT Classification and periodical reviews of Branches and distributors  - Guiding the Branch/Plant team on Waybill/ Road Permit management for ensuring timely delivery of goods across India for retail business  - Maintaining Trackers for Assessments Status & CST Forms of all the States and coordinating with the Branches and Plants for timely completion of Assessment and submission forms to avoid exposures.  - Withholding Tax Compliances on Works Contract.  Appeals and Litigation  - Representing before the Excise & Service Tax Authorities on the queries related to legal provisions.  - Appearing for hearings up till CTO/JC (A) level  - Handling the VAT Classification of PVMI and Distributors across India and other cases of PVMI including the reply to the Show Cause Notices, Drafting Appeal, Appearing before CTOs/DC(A).  - Ensuring the Stay of demands in legal cases / Avoiding recoveries against PVMI or DBs  - Regular monitoring of status of pending appeals up to CESTAT /Tribunal level  - Ensuring that the Advocates and Consultants across India are provided with proper inputs, documents, papers etc. required for the presenting before all the judicial forums including the Distributors Advocates/Consultants.  - Assisting Legal Team in Indirect Tax Cases at High Court level with all the documents, data, tax updates etc.  Miscellaneous  - Preparing SoPs & Internal Control Questionnaires and update them on regular basis.  - Contingent liabilities, Provisions related to cases - tracking and reporting  - Maintaining provision sheets for Excise/VAT etc.  - Maintaining Litigations Management Software and provide the reports  - SAP updates Monitoring/Reconciliation  - Updating on GST related developments  Education, Qualifications and Training:  - CA/CS/CW A/LLB with Commerce Graduation  Experience required (e.g. Past Roles, Level, Years- Experience, Technical, People-Management:  - CA/CS/CWA (minimum 5 years of experience in IDT) and LLB (7 years of exp.in IDT) - Among overall experience, minimum 2 years of Manufacturing organization is essential  Specialised Knowledge or Skills required (e.g. Technical, Cross-functional, etc.):  - Good knowledge in Excise, Service Tax & VAT provisions, Module Draft GST Laws
