LOCATION MUMBAI

REPORTS TO DIRECTOR & HEAD LEGAL AND COMPLIANCE

QUALIFICATION MASTERS OR GRADUATE OF LAW FROM REPUTED UNIVERSITY

WORK EXPERIENCE 10-12 YEARS [5 years as an in-house lawyer in a similar role as an individual contributor and 5/7 years supervisory experience]

THIS ROLE

- Provides guidance and advice to team involved in prosecuting or defending criminal, civil and consumer cases for and against the Company and IP matters related to filing, rectification, challenges and proceedings before the Office of Controller General of Patents, Designs & Trade Marks or defending against allegations of infringement, passing off or contributory liability

- Requires a quick study to develop the thorough knowledge of the organization's products/services.

- Manages subordinate staff in the day-to-day performance of their jobs. True first level manager. Ensures that project/department milestones/goals are met and adhering to approved budgets.

- Has full responsibility for litigation outcome and budgets. Efficiently manages external counsels, arguing counsels and law firms.

- Extensive and in-depth knowledge of criminal and civil procedure code, consumer act proceedings and intellectual property filings and actions.

- Adherence to the highest professional and ethical standards is a non-negotiable requirement.

DUTIES AND RESPONSIBILITIES OF THE ROLE

- Meeting with and advising business, operations and functional teams on ongoing or potential litigation.

- Ability to identify potential litigation and proactively plan action to mitigate legal, business and financial risks client. Review details of cases and determine a strategy should the case make it to trial or advise teams about handling the case out of court.

- Prepare for trial. Assemble names of potential witnesses, arrange for expert depositions, interview witnesses and other parties relevant to the case, and examine evidence that could be used as trial exhibits. Develop strong defense in reactive matters and ensure that the Company's interest is protected and there is no loss of business momentum.

- Be a self-starter and self-motivated individual and display high ownership and enthusiasm at work.

- Develop a trial strategy to win the case. During court proceedings, work closely with law firms and external teams to present evidence, make opening and closing statements, examine and cross-examine witnesses and experts, and argue motions.

- Keeping Function Head current on developments. Prepare and submit updates and reports.

REQUIRED SKILLS FOR THE ROLE

- Keep abreast of latest developments in judicial review and applicable law. Develop and implement knowledge share sessions.

- Possess strong verbal and written communication, research, organizational and analytical skills. Detail-oriented and the results-driven team player.

- Adept at communicating with people of diverse ethnic and social backgrounds.

- Knowledge of basic computer applications. Developing internal procedures, promoting effective teamwork preparing and reviewing court filings. Developing trial strategies, develop and implement a wide range of best practices.

- Ability to work effectively and collaboratively as part of a senior management team responsible.

- Strong legal editing, writing, and analytical skills. Organizational and management skills for development and implementation of procedures and guidelines to facilitate the effective oversight of cases.

- Significant experience with coaching, training, and mentoring of a legal team.
