Principal Accountabilities:
Strategic:
COLLATERAL MANAGEMENT:
- Monitoring the receipt of all the Original and Copy documents as stated in the LSR.
- Updating the receipt of all the Original and Copy documents as stated in the LSR in the File Forwarding System.
- Tracking and confirming the receipt of all the Legal OTC and PDD documents.
- Ensuring the completion of Registry process in SRO/Registry and collection of Registered Documents promptly for Purchase Cases.
- Tracking and collection of all the Title Documents and others in Balance Transfer cases.
- Receipt of all the Original Title Documents from Cluster Business Managers/Cluster Legal Managers and updation of the OTD in the File Forwarding System.
- Forwarding all the OTD documents to Corporate Office within T+2 days.
- Confirming that all the Title Documents are safely deposited with the RMC.
- Coordinate with RMC for collection of Original or Copy of the Title Documents and other documents and submit back the documents safely to RMC.
DELINQUENCY CONTROL:
- Reviewing the Non-Performing Accounts (NPA) in the Region periodically.
- Ensure Demand Notices, Legal Notices are sent to all the delinquent customers as per the Compliance Calendar.
- Ensure appropriate Legal Actions are initiated against the delinquent accounts/NPAs HLF - LOAN AGAINST PROPERTY
- Implementing effective Delinquency Control and Litigation Management, as stated above, for HLF-LAP.
- Initiating SARFAESI proceedings against the NPA customer of LAP Product (HLF) and timely follow.
- Providing Solutions/Suggestions for legal queries raised by various departments of LAP Product (HLF)
Tactical:
TITLE VERIFICATION:
- Review the Legal Report and Approve the LSR in system
- Monitoring the compliance of all the Legal Conditions as stated in the LSR.
- Ensuring all the title documents are mentioned in the - List of documents to be collected- as OTC and PDD in ERP correctly.
- Ensure the Vetting Reports are obtained for all the Original Title Documents.
LITIGATION MANAGEMENT:
- Filing complaints with Police, statutory authorities against the fraudulent customers and ensure prompt measure are taken against them.
- Based on the facts of the each and every case, suggesting best possible legal solution for the recovery of NPAs.
- Ensure cheque bounce cases and Arbitration Cases are initiated against all the 90+ cases and 120+ cases respectively and ensure the submission of all the documents/details thus ensuring Judgements/Awards are passed in the shortest period possible.
- Reply to Legal Notices either by self or through Legal Vendors/Advocates promptly and accurately
- Updating of amendments in existing law, new enactment, Judgements, circulars, notifications of Statutory Authorities impacting the business to the management.
- Timely submission of MIS on Litigation to the Management.
Supervisory:
VENDOR MANAGEMENT:
- Selection, Review, Verify and Appoint Legal Vendors for the Region.
- Train and update the existing/revised internal legal policy to Legal Vendors periodically as per the compliance calendar.
- Ensure that the LSRs are submitted within TAT without compromising the quality.
- Verifying and certifying all the Legal Vendor Bill for the Region and ensure timely clearance.
- Periodical audit on Random basis on LSRs.
MANPOWER MANAGEMENT:
- Recruit and on boarding of Cluster Legal Managers for all clusters in the region.
- Training Cluster Legal Managers about Company's Internal Policy/Guidance Notes and ensure complete compliance of the Internal Policy/Guidance Notes implemented effectively by Cluster Legal Managers.
Person Profile:
Educational Qualification: LLB - Law/ Post Graduate
Experience:
- Candidate should have done LLB degree from a reputed college, having 10-15 years- experience with at least 6-7 years with a reputed Banking & NBFC industry or a reputed Law Firm.
- Preference will be given to Banking & NBFC industry candidates.
Specific Skills:
- Post qualification hands on experience, preferably working with reputed Legal Firms thorough knowledge of Corporate laws and Banking & NBFC industry related Laws such as Land laws would be an added advantage.
- Expert in legal drafting & litigation.
- Excellent verbal & written communication skills (English).
- Good Team Player
- Work experience on buying/ selling distressed assets from another jurisdiction and in general and commercial disputes will be a bonus.
- Critical Skills required: Contract Negotiation, Due diligence. Litigation skills and experience with arbitration and mediation in local and national courts will be a plus.
- Possess a high level of maturity and tact to manage and collaborate with key stakeholder.
