Hiring for Real Estate based client out at Gurgaon

Role: Head Legal

Industry Type: Real Estate

Functional Area: Leading the legal team, litigation and legal functions at Pan India.

LLB from reputed institute

Job description :

Experience - 15+ Years of experience in real estate (of which 5 years in real estate developer firm would be preferable).

1. Assist in drafting of all transaction and contract related documents from a legal perspective and ensure that the associated risks for Experion are reduced to zero

2. Assist in evaluation of land records and conducting a through due diligence for all deals and transactions, highlight concern areas and recommend risk mitigation strategies / options

3. Evaluate the impact of evolving legal and statutory regulations on the company's current and proposed investments and highlight the same in a time and contribute to the business planning process

4. Provide legal support in senior management forums in policy formulation for the company

5. External interface with customers and business partners on all issues of disputes and policy interpretation

6. External interface with all Experion partners in contract definition to mitigate risk

7. Interface with advocates and solicitors on the behalf of Experion to handle litigation, obtain legal advice and legal services

8. Support all functions of the company to effectively monitor and enforce the contracts from a legal perspective and lead the litigation process if required in close coordination with the concerned function

9. Provide legal support in drafting and vetting of sale / purchase agreements, LOA, Lease / Leave license agreements, Memorandum of Understandings (MOUs), Joint Venture agreements, Shareholders' agreements, employment agreements, Job arrangement letters with the consultants etc, as and when required

10. Provide legal administration services and institutionalize legal support and control processes across different functions in the company and with the business partners (if required)

11. Guide the company in interpretation of laws regarding all aspects of business and corporate life including construction laws and regulations applicable to the business

12. Provide legal controls and checkpoints for the existing organization by managing the Legal department

13. Define the scope and supervise all legal agreements for Experion. Assist various internal customers in ensuring that all contracts, tenders and agreements are vetted from a legal perspective and cover the business risks for the company

14. Setting up systems to ensure compliance with statutory requirements through proper documentation and adherence to established processes

15. Archiving and retrieval of legal documentation, backup and disaster recovery plan for the same

16. Institutionalize a legal escalation framework and support internal audit to review and improve the same

17. Identify external legal counsels and consultants for various jobs as and when required and liaison with them to actively support the company's objectives and minimize the legal risks to zero

18. Mentor and coach location purchase and stores to improve their performance and increase their competencies

19. Conduct training sessions for internal customers on contract drafting and educating on legal issues related to their respective areas of operation.
