Reputed firm engaged into acquisition of distressed financial assets from the banking system is inviting applications for legally qualified senior candidate with 20+ years of experience from a Law Firm, NBFC, Bank, Financial Institution, ARC or Corporate with an expertise in dealing with defaulting borrowers and managing the recovery and resolution process. The candidate should have a strong understanding of insolvency and bankruptcy law including the RDDB Act, the SARFAESI Act, and Negotiable Instruments Act etc and have experience in the Debt Recovery Tribunal (DRT) and Debt Recovery Appelate Tribunal (DRAT). The candidate would have the following roles and responsibilities. - To formulate legal strategy for the resolution and recovery from a stressed account. - To monitor and control all the cases and follow up with the resolution team and appointed lawyers/counsel. - To provide necessary information, facts and documentation to the counsel to pursue the recovery process. - Drafting, vetting and finalisation of recovery claims, replies and rejoinders and SARFAESI notices and petitions, - To identify lawyers for empanelment in different jurisdictions and forums. - To guide and support the resolution team for drafting various applications and pursuing recovery. - To brief lawyers for arguments in different forums for the stressed accounts/cases - To represent the company as an authorised representative (AR) in various forums .
