Job Title - Employee Relations Head

Reports To (Title) HR Director

Job Summary:

- Lead and oversee maintenance ofstrong industrial and employee relations for organization stability, by:

- Managing a large, unionized workforce dispersed across locations

- Applying deep understanding of prevailing labour laws, statutory and regulatory requirements to ensure compliance and establish appropriate risk mitigation mechanism

- Building and maintaining strong relationships with all stakeholders involved - unions, workers committee, employees, Govt. and other statutory authorities

- Providing continuous support to business and HR teams in managing employee related issues

- Scope of direct and indirect staff managed is close to 1,25,000 resources

Job Responsibilities and Accountabilities :

Employee and Industrial Relations Strategy

- Design & evolve Industrial relations strategy PAN India

- Developsound & transparent ER policies for effective Management, Union-Employee Relations

- Ensure implementation of the devised employee/ industrial relations strategies and policies as per location specific requirements

- Follow a Proactive IR Management strategy to identify potential IR/ER risks to the business and put mitigating mechanisms in place

- Develop and ensure implementation of strategies for client IR & statutory risk management

- Identify implications of any changes in statutory requirements for organization and address issues emerging from it

- Have a thorough understanding of the general trends and interpretations for labor relations in the national and local context

- Ensure standardization of IR decisions across the country factor in any major exceptions in bargaining/negotiating with unions

- Liaise with Legal Advisors for conducting on-going labor related litigations 20% - Business Impact of IR incidents (cost, business continuity - mandays lost)

Industrial Relations Management:

Engagement:

- Develop and maintain relations with Trade Unions and Workers Committees

- Develop and maintain relations with Statutory Regulatory and government bodies

Coaching and Advice: 

- Provide ongoing advice to Service Delivery Head and Hub Heads on strategies for managing ER/IR risks and dealing with unions/ direct staff where required

- Provide coaching to Hub ER Manager, HRBP Hub and other HR stakeholders on how best to address IR issues

- Engage and influence employees to ensure management of IR risks at client site 20%

Compliance, Discipline and Governance: 

- Ensure compliance with all Labor Laws; liaising with statutory and civil authorities from time to time

- Ensure timely fulfilment of statutory compliances under various acts i.e. ESI, PF, Shops and Establishment act, Payment of Bonus act, Payment of Gratuity act, Minimum wages act and Payment of wages act

- In case of escalations and exceptions,

- Facilitate and ensure adherence to the grievance handling process with the view of ensuring industrial harmony and positive discipline

- Independently handling the disciplinary process such as framing and issue of charge sheets, Show Cause Notices, Explanations, suspension and terminations through domestic enquiries

- Work with the broader HR team to design and deliver the rollout of new policies specific to Employee Relations areaLead and ensure Contract Labor Management and Employee Welfare pertaining to Statute & Company

- Lead bargaining with Trade Unions and Workers Committee and coach team members on the negotiation strategy

- Negotiate and amicably settle disputes with the Union and maintaining discipline & harmonious working environment across all employee levels

- Represent the company in labor courts, tribunals and conciliation proceedings

- Monitoring statutory compliance & liaising with external agencies /Govt. authorities & offices 50% - Number of IR incidents reported

- Number of IR incidents resolved/ unresolved

- Turnaround Time for resolution

Health & Safety: 

- Ensure observance to highest standards of organization's Health & Safety norms, particularly for direct staff

- Identify and appropriately raise any Health and Safety issue to the H&S Head 10% - Number of Health & Safety Incidents

Qualification and Experience Required: 

Qualification: 

Minimum: MBA/ Master's degree or equivalent in HR/Personnel Management Desired: Master's degree or equivalent in Law

Relevant Experience: 

- Minimum 12-15 years of overall experience

- Minimum 6-8 years of experience in relevant industry and domain

- Must possess ability to manage IR with highest ethical standards

- Ability to understand and interpret relevant legislation and regulatory provisions

- Ability to remain calm and unruffled in challenging or surprising situations

- Experience of handling multiple unions across multiple locations in a distributed business

- Experience in dealing with Labour, PF departments and other Govt. bodies

- Ability to demonstrate tact and diplomacy in handling external stakeholders

- Experience and ability of handling wage settlements
