Head - Direct Tax - CA (8-13 yrs)
The broad objectives of this position are:
Direct Tax planning and Management
a) Undertake tax planning for the organization (domestic and international); structure the organization's operations to maximize tax benefits in line with the tax laws and achieve the overall organization goals.
b) Advise management for the impact of income tax laws, decisions, regulations and rulings and of proposed legislation in taxation and related areas.
c) Review proposed major transactions in their formative stages and advice or proposed changes consistent with the overall business purpose and strategy to achieve the best tax results.
d) Keep a track of changes in taxation laws and make management aware of the same and implement the same.
e) Supervise and ensure Direct tax compliance .
Direct Tax Compliance -
a) Represent the organization on tax matters before various Tax and legislative authorities.
b) Handle Income Tax assessment, appeals, audit objections, surveys etc.
c) Organize and supervise the preparation and submission of ruling requests, refund claims, protests and appeals relating to tax matters.
d) Ensure filing of income tax returns, make provision for taxes, Payment of Advance tax and tax dues; Resolve all issues related to domestic and international tax laws.
e) Keep abreast of the tax regulations and seek exemptions/benefits wherever applicable. f) Co-ordinate and ensure timely completion of tax audits, R&D Expense audits, transfer pricing audit and studies and other audits as per tax laws.
Tax Audit and filing of Income tax return -
a) Review Tax Audit Plan and the details received from Various stake holders
b) Co-ordinate with Tax auditors .
c) Ensure and guide the team in Preparation of Tax Audit Statements
d) Review & check the details provided for Tax audit. Ensure timely completion of Tax Audit.
e) Resolve the queries of tax auditors and ensure timely filing of form 3CA and 3CD.
f) Compute taxable Income and file Income tax return before due date.
g) Ensure the filing of Income tax Returns Gratuity , superannuation and welfare Trust before due date.
TDS / TCS Return, Payments, TDS accounting -
a) Guide and monitor the filing of TDS and TCS returns.
Tax Provisions, Income Tax notes and slides for Board Report -
a) Review AOP - Provision for tax.
b) Review Quarterly provision for Income tax and deferred tax
c) Preparation of Board report for Income tax and deferred tax
d) Review Income tax related notes to the Financial Statements.
e) Review pending Income tax cases and note for contingent liability.
f) Review Current and non-current break up of Net Tax paid in advance
Advance tax and Accounting -
a) Review Advance Tax Computations and Ensure timely payment of advance tax
b) Attend departmental queries on advance tax & demand payment and attend the hearings.
c) Ensure proper accounting based on Assessments / Appeals / ITAT orders.
Compliance related to R&D Weighted Deduction -
a) Prepare documents and apply for renewal of Recognition of R &D center.
b) Filing of form 3CL and complete assessment with DSIR.
Assessment, appeals and other Income tax compliance -
a) Guide in preparation of replies and review submissions for Income tax assessment/reassessments.
b) Guide in preparation and review of Filing of appeals with CIT(A)/ITAT
c) Prepare submissions for appeals, notices, enquiry, survey etc.
d) Follow up with Income tax department for refunds, assessments, appeal effect etc.
e) Ensure completion of Income tax assessment.
Transfer Pricing Audit -
a) Finalise the associated enterprises and related parties for International Transfer Pricing. b) Review all the transactions with associated enterprises.
c) Review the documents, back up files and and ensure submission of details for TP audit d) Ensure timely completion of Transfer pricing Audit and file 3CEB before due date.
Salary and Trust-
a) Ensure Timely payment of salary , accounting of salary JVs, timely statutory payment such as PF, ESI, PT, TDS, timely preparation and submission of monthly Salary MIS.
b) Ensure Correct deduction of employee tax and compliance related to issuance of form 16, tax declarations etc.
c) Ensure activities pertaining to payment and settlement of superannuation, leave encashment, Gratuity, NPS etc.
d) Ensure Actuarial valuation and accounting of all employee benefit schemes -Ensure proper Disclosures in the annual report.
e) Ensure Full and final settlement of employees.
f) Ensure timely accounting, audit, changes/amendments in deeds of Gratuity, Superannuation and Welfare Trust etc.
e) Monitor investments of gratuity trust & ensure safety and maximum return on investments.
f) Co-ordinate with statutory auditors for audit of benefits and other disclosures.
CA with 8 plus years of post qualification experience in manufacturing company and a stable career graph is also a must.
