Job Purpose:

Devise a litigation strategy for Organization to drive and manage all direct and associated litigations and ensure favorable outcomes and protection of best interests for Organization.

Key Accountabilities:

Accountability:

- Implement the litigation strategy formulated by CLO India across all businesses by taking inputs from key stakeholders to protect the best interests of Organization

Activities:

- Create a panel of attorneys/law firms across relevant geographies to ensure adequate representation for Organization on all litigation aspects in court

- Appoint appropriate counsels based on the specific case requirements

- Work closely with zone-specific teams to ensure all necessary litigation support is provided to them as required

- Provide backup legal support for litigation activities performed by the external counsel Endeavour to protect management from criminal proceedings and ensure appropriate defence/ representation is given before the Court of law(including cancellation of warrant, statements before police authorities etc.)

Accountability:

- Provide guidance and direction to external advocates both in India and Internationally to minimize adverse publicity and monetary exposure for Organization and ensure favourable outcomes in cases

Activities:

- Provide case briefings to the external advocates' case and support them in finalising the company's stand and arguments in court

- Perform case review and investigatory legal research by studying local statutes, codes and reports to prepare a well-analyzed summary of litigation

- Evaluate and endeavor to resolve all types of litigations (such as product related, employment litigation, recovery, trademarks etc.)

- Identify, prioritize and drive resolution/closure of litigation issues in a timely manner

- Ensure continual follow-up of all outstanding litigations with the external team and strive for a speedy and favourable closure

- Review and supervise litigations in appropriate circumstances to minimize the risk exposure to company

- Educate and train the management (top leaders and up to two layers below top)on how to avoid future litigations Regularly update and review litigation data

Accountability:

- Handle out of court settlements, arbitration matters & their proceedings and represent the organization in statutory forums and regulatory agencies

Activities:

- Provide end to end support in the resolution of claims and disputes prior to litigation

- Advise the business leaders on dispute resolution provisions in all contracts and update templates

Accountability:

- Establish and implement necessary procedures and systems for recording and monitoring litigation involving the company to ensure effective litigation tracking and management

Activities:

- Develop and implement a database/record management system for tracking litigation status and recording case briefs/ summaries

- Assist CLO in monitoring pending legislation by obtaining copies of legislative bills or additional information from various state legislatures and summarizing the findings

- Develop and organize data necessary to generate monthly/yearly reports on cost of litigation and/or collection cases to ensure the effective administration of the litigation budget and expenses

Accountability:

- Establish and implement necessary procedures and systems for recording and monitoring litigation involving the company to ensure effective litigation tracking and management

Activities:

- Develop and implement a database/record management system for tracking litigation status and recording case briefs/ summaries

- Assist CLO in monitoring pending legislations by obtaining copies of legislative bills or additional information from various state legislatures and summarizing the findings

- Develop and organize data necessary to generate monthly/yearly reports on cost of litigation and/or collection cases to ensure the effective administration of the litigation budget and expenses

Accountability:

- Mentor the team on court procedures and guide them to handle litigations independently

Activities:

- Review and provide feedback on proceedings prepared by the team members to be filed in court and before various authorities

- Review and provide feedback to team, on notices and replies to be submitted to private parties and government authorities

Accountability:

- Provide support on special projects on a case- to- case basis

Activities:

- Conduct legal review for all India in-licensing depot and admin contracts and endeavour to cover all aspects protecting the organization and its interests
