Reporting to : Head, Regulatory Operations, India & SA

Purpose of the Job

1. To protect and safeguard the interest of company in a rather complicated business environment by advising the management on day to day legal and regulatory issues and to help the circle teams to achieve the business goals.

2. To ensure compliance on regulatory and licence conditions. Monitor and report compliance to the senior management and to drive the action plans where ever needed for ensuring compliance with the respective functions.

3. Educating the circle function heads on new legal & regulatory requirement and providing guidance in meeting the same with least impact to business.

4. Help business teams to develop regulatory compliant products and plans for the subscribers, filing the same with authority as per the requirement.

5. To develop, conceptualize and implement Legal strategies in order to safeguard against any financial exposure, adverse orders , prosecution etc

Deliverables (Maximum 5-6 key responsibilities)

1. Ensure process & product compliance of all regulatory directions/ statutory compliances in circle. PRegular periodic compliance monitoring & reporting to the senior management.

2. Timely submission and reporting of data to external & regulatory agencies including presentation of company stand before them.

3. Drive compliance thru action plan formation where ever there is compliance gap. Handle regulatory compliance audits from TRAI and internal auditors.

4. Prepare litigation strategy with external counsels to defend & safeguard company ‘s interest, mitigate financial exposure, defend & initiate criminal prosecutions etc. Strategize to mitigate revenue leakages/ initiative recovery initiatives through legal intervention.

5. Build strong relationship across levels within all concerned state agencies, statutory and tax authorities, regulatory bodies in order to ensure smooth operations & implementation of company strategies in market without any administrative & legal hindrance.

6. Negotiate, advise and implement commercial contracts with vendors/ channel partners in line with all statutory & regulatory requirements

Major Challenges :

- With increased regulatory complexity with addition to setting up of TERM cells and now TRAI regional offices at Circle level and also because of the heightened sensitivity of the police and security agencies on security issues, the pressure to ensure compliance has increased manifolds.

- Specially the leading operators are targeted by the law enforcement agencies to set example and to give signals to the industry so the incumbent has to be equipped to continuously engaged with statutory and regulatory bodies on policy advocacy, timely submission of data & reports, handling the regulatory & statutory audits, representation of company stand before such authorities, monitoring & reporting compliance to the senior management .

- In bigger and integrated circles there are multiple TERM cells and need more effort and superior managerial skill to meet different requirements and varying interpretations.

- There are complex litigations like service tax matters, Central excise matters, Entry Tax matters, Local body tax, RoW , trade union issues and labor disputes which demand good knowledge, competency in relevant domain and superior management skill.

Educational Level

Must have:

- Bachelor Degree of Law

Working Experience

Must have:

- At least 12 years of work experience and 5 years in Telco Legal & Regulatory or related industry.

- Managerial experience and strong litigation & regulatory background with exposure to handling / interaction with administrative & regulatory authorities

Dimensions

Impact of position on :

i) Revenue

- Any non-compliance or dip in subscriber verification Audit score or breach of License condition would mean penalty running into crores.

- Adverse action by Judicial authorities will have serious consequences in terms of revenue exposure.

- Environment, Police/ Law enforcement agencies management is important as they may harass the employees and channel partners.
