Hiring for a leading NBFC

Job Purpose

This Job will be responsible for :

- Addressing all legal issues of Rural Finance Business

- Target based time bound recovery in Loss Recovery and Write Off accounts through legal actions, which adds to the bottom-line;

- Reduction in GNPAs through legal actions,

- Leading a team of on roll legal professionals, full time legal retainers and off-roll para legals. i.e. both as well as against the Company,

- Providing litigation support to the entire financial services group

PRINCIPAL ACCOUNTABILITIES

1. Head - Litigation (Rural Finance) - This position is responsible for addressing all legal issues of All Group Entity, either himself or through in house resources or through external resources.

2. Litigation Support : This position provides litigation support to the entire financial services group.

3. Strategizing the legal actions: - This position is responsible for strategizing the legal actions on behalf of the Company. For that, he has to engage in continuous discussions with the Sales Team and other Business Groups to understand their requirements in terms of reduction in GNPAs, recovery in Loss Recovery & Write Off accounts. This also includes strategies to safeguard Company's interest in cases filed against it.

4. Handling volume of Litigations : This Position is responsible for successfully handling volume of legal cases filed by the Company against defaulters such as arbitration proceedings before arbitrators, petitions for execution of arbitration awards, petitions u/s 9 of Arbitration & Conciliation Act, 1996, criminal complaints u/s 138 of Negotiable Instrument Act, 1881, criminal complaint against defaulters under Indian Penal Code, Winding up petitions, Suits, summary suits, pre-litigation lok-adalats, etc. as well as well as cases filed against the Company such consumer cases, suits, criminal cases against the Company, its employees and directors, etc.

5. Leading a Team:- This position is responsible for leading a team legal professionals working in different capacities pan India as well as legal retainer and para - legal staff as well as for their training and development.

6. Development of Systems and Processes: This position is responsible for development of systems and processes and their effective working in order to ensure smooth functioning of the department as well as achievement of the Organizational, Department and individual goals in terms of KPIs / KRAs. This position is also responsible for maintenance, updating and timely circulation of MIS w.r.t. legal cases to all concerned.

7. Advising: This position is responsible for advising Sales Teams and other Business Teams on legal.

8. HR Related issues : This position is responsible for manpower planning of the department, preparing budget of the department, recruitment, training & development and growth of the team members, their performance appraisal.

9. Networking: This position is responsible for the establishing and developing network with advocates, sr. counsels, police authorities, various offices attached to the court such as Court Receiver / Advocate

Receiver / Advocate commissioners, Official Liquidator, Official Assignee, legal professionals working in other companies, etc. This positions is also responsible for empanelment of advocates and other service providers pan India.
