AVP/Vice President - Legal - Asset Reconstruction Company (10-30 yrs)

Job Description :


1. Candidates from Banks, ARCs, NBFCs and other Financial Institutions are preferred

2. Drafting and vetting of various other agreement, deeds, letters and communications;

3. Documentation for security and facility agreement while granting loans/additional funding to Borrowers (from ARC or NBFC);

4. In case of ARC acquisitions, vetting and finalising covenant of Trust Deed, Offer Document and Assignment Agreement, Restructuring Agreement

5. Legal due diligence of various stressed accounts;

6. Coordinating with vendors/ Sub Resgistrar office agents for Registering the Assignment Agreement;

7. Preparing case of opinion and briefing the same to law firms; Briefing Advocates, Senior Counsels, Law firms and timely follow-up of cases;

8. Updating Legal MIS, tracking matters on daily basis;

9. Checking all the websites of Regulator's and updating the data base with new circulars, notification, amendments etc;

10. Enforcing of Security Interest under SARFAESI (issuing demand notice, possession notice, filing application with CMM/DM and taking possession thereof);

11. Engaging Law Firms to represent the Company at various forums and attending the matters;

12. Initiating legal actions under RDBBI Act, such as filing of OA before DRT, appeal before DRAT, recovery proceeding, obtaining recovery certificate and auctioning the secured assets;

13. Attended CoCs meeting as lender to Corporate Debtors as well as RA under IBC;

14. Updating with judgments pronounced by NCLT,NCLAT, HC, SC

15. Initiating actions under IBC, such as filing application under section 7, 60(5), Filing claims forms etc.

16. Drafting of Resolution Plan under IBC1. Candidates from Banks, ARCs, NBFCs and other Financial Institutions are preferred
