Manager - Legal (Property + Documentation + Litigation)


Job Description :


Roles and Responsibilities :

- Experience in Land and revenue-related matters and having a working knowledge of the local land laws.

- Coordinating with the Group Companies for handling all matters related to land and revenue.

- Verifying the documents and procuring additional documents, if required, from authorities and maintaining a database of all land records.

- Drafting of conveyance deed/sale deed or in the alternative coordinate with the local advocate for drafting and finalization of the conveyance deed/sale deed.

- Co-ordinating with the concerned team for registration of the conveyance deed/sale deed

- Responsible for issuing and replying to Legal notices and all routine correspondences related to land and revenue.

- Be updated with the latest laws and judgments related to land and revenue matters and be capable of providing an opinion.

- Develop and implement proper litigation management and dispute resolutions strategy for effective delivery and timely resolution of legal matters to obtain positive outcome together with the Legal Counsels/advocates/Law firms

- Analyzing legal issues, searching statutes, preparing briefs, opinions, and important legal decisions by High Courts and Supreme Court required in judicial proceedings which will enable to decide prospective strategy in any litigation matter.

- Drafting, vetting/reviewing/ approval of all necessary legal pleadings i Petitions, Appeal, Plaints, Written Statements, Rejoinders, Affidavits, Counter Affidavits and Written Arguments, notices of recovery etc in coordination with external counsel for timely submission before any Judicial/Quasi Judicial Forum.

- Drafting/Vetting/Reviewing of wide variety of legal contracts, agreements and other legal documents to meet specific needs of the business based on briefing received and to ensure the company's full legal rights

- Support sales and other business teams including services groups in different region, provide them with strategic and legal inputs on matters across different business areas.


- Proactively work for Standardization of regular agreement such as supply agreements, dealer agreements, distributor agreements catering to different business vertical.

- Provide clarification on legal language of specific contract, agreement and other legal documents or specifications to business teams of various businesses as per their requirement.

- Verifying clauses of contracts with Statutory and company policies & highlighting changes required in agreement; convincing the business team members to accept suggestions and obtaining suitable reasons for the changes.

- Tracking status/ outcomes of the cases filed by/ against the company and maintenance of case lists, records and MIS with updation of cases.

- Providing legal inputs, guidance, feedback and advise on all land and revenue matters.

Desired Candidate Profile :

Good Knowledge and experience of various Land related acts Including but not restricted to the below :

a. Maharashtra Land Revenue Code -1966

b. Maharashtra Rent Control Act

c. Maharashtra Agricultural Lands and Tenancy Act

d. Maharashtra Restoration of Lands to Scheduled Tribes Act, 1974.

e. Maharashtra Regional Town Planning Act

f. Mumbai Municipal Corporation Act

g. Real Estate (Regulation and Development) Act

h. Transfer of Property Act

i. Maharashtra Stamp Act

j. Indian Registration Act

k. Maharashtra Village Panchayat Act

l. Maharashtra Public Trusts Act

m. Maharashtra Co-operative Societies Act

Revenue Clearance :

a. Zoning, Tenure of land, Type of lands, Land tenancy, 7/12 extracts, Mutation, N.A. Orders,

b. Sub -Register Office works: Apply for Non Encumbrance Certificate, Certified copies of documents, Source of Land, Family Tree and Death certificates, Preliminary opinion for agreement, Survey and related work, Sale Agreement, obtain for Government Survey, Sale Deeds, and Registrations.

c. Conversion Activities, Corporation Clearance, Govt. Liasioning Activities for land / revenue related matters.

Person should have hands on experience in :

i) handling complex land matters involving issues under various land laws including but not restricted to title, possession, encroachments, mortgage/ hypothecation, gifts, Trusts, easement, adverse possession, tenancy etc.

ii) Protection of land (open land as well as factories), tenancies, ownership/ leased flats/ apartments, held by the Company.

iii) Providing strategic advice to resolve land and revenue issues and proactively take steps to minimize the risk associated.

iv) Handling general correspondences with various authorities.

v) Responding to any legal notices or issue legal notices wherever necessary to defend/protect company properties.

vi) Handle the litigations connected with the land and revenue matters, attend court hearings and co-ordinate with lawyers to get the litigation disposed of expeditiously.

vii) Maintaining electronic database of all original land documents and periodically updating the same.

viii) Maintaining summary of all properties ( event wise from acquisition of the same till date)

WORK EXPERIENCE : 10 years out of which a minimum of 5 to 7 years must be in hard core real estate and revenue matters, dealing with Government officials and various authorities under land and revenue department. Should be adept in handling complex land and revenue matters. Must be proficient in MS office.
