The role holder will be responsible for managing the ER function and maintaining positive working relationships and also supporting other legal entities across India.

The incumbent will ensure compliance with policies and India employment law, and mitigate ER and change risks.

The role holder will provide expert advice in relation to complex ER issues and cases across the full range of the Bank's activities, balancing technical input with practical and commercial advice.

Additionally, the incumbent will have a core client group within the HR community and senior leaders and will be expected to partner with them on a day-to-day basis.

Disciplinary, Capability and Grievance Case Management: Drawing on internal and external factors as appropriate, the individual will provide expert advice and individual coaching to the ER colleagues at all legal entities in India, HRBPs, and Senior Leadership, assuming responsibility and accountability for the most complex and challenging D,C&G cases and those which may result in significant commercial, legal and reputational risk. Key areas include:

- Investigations and suspensions

- Disciplinary processes (misconduct and gross misconduct)

- Capability processes (including Performance Improvement Plans and Attendance Improvement Plans)

- Complaints and Grievance processes

- Partner with legal team in cases of employee litigation

Change Management and Restructuring Programmes :

- Provide expert advice and oversight to the ER colleagues, HRBPs, Line Managers and Senior Leadership on all aspects of Change Management and Restructuring Programmes.

Key areas include :

- Legislative requirements

- Change management governance and process control

- Execution of specific change projects:

- Preparation of business case and rationale

- Stakeholder engagement

- Selection and benchmarking process

- Employee communications

- Quality assurance

ER Policies, Processes and Collateral :

Shape and lead ER policy and collateral development and continuous review, ensuring that such policies and collaterals are accurate and reflect current employment legislation and market practice. Ensure that all ER policies are aligned and are followed in a consistent manner across India.

Knowledge Transfer :

- Lead the development and delivery of ER training workshop to up-skill HRBPs and Line Managers to build knowledge and increase capability, and to minimise and mitigate ER risk.

Risk and Governance :

Oversight and accountability for ER advice and guidance provided in relation to:

- Advising on operational employment law, its application and legal risk

- Reviewing and monitoring control mechanisms to mitigate risks

- Ensuring controls are in place to maintain data and documentation

- Representing ER at pan-India Forums and Committees

- Analysing Management Information (MI) required for identifying and resolving key issues identified, and briefing senior management on issues identified and potential mitigation activities

Supervisory responsibilities :

The incumbent may be required to exercise supervisory responsibility over 1 to 2 ER advisors in India (to be confirmed).

Key clients :

- Primary internal clients will be the HRBPs, Senior Leaders from within the business and ER colleagues from other jurisdictions.

Professional/technical experience :

- The candidate should have significant experience delivering high quality ER or Employment Legal support to a sophisticated and commercially focussed blue-chip client base, preferably within the financial services, investment management or professional services sectors.

- The candidate should also have significant hands-on experience managing an ER or Legal centre of excellence.

- The candidate will be able to demonstrate practical breadth and depth in the core areas of ER or Employment Legal and be able to quickly apply a combination of technical and commercial thinking to any business issue arising.

- In addition, the candidate will have a track record of operating at senior organisational levels within the direct ER and wider business environment and the experience to assume responsibility for a portfolio of complex and/or high profile ER cases, gained through material front line exposure to relevant issues.

- The incumbent will also be able to demonstrate solid competence in all aspects of India employment law.

- The incumbent must possess experience in training and up-skilling other colleagues on the subject (Employee Relations and Change management)

Academic and professional qualifications :

- Graduate with a specialization in Human Resources or Law. Any additional qualification may be an added benefit.

Language skills :

- Strong written and verbal communication skills are a critical requirement of the position.

Personal attributes :

- The incumbent should be action orientated with a focus on continuous improvement in all areas of his/her work.

- Known for high energy, productivity and professionalism, able to deliver quality results with a challenging but positive and influential style.

- Should have the ability to manage and influence senior stakeholders to support change recommendations and mitigate risk.

- Should be creative but pragmatic, conceptual but able to deliver at speed. A relationship builder with a reputation for displaying values, evoke rapid trust and openness in clients, colleagues and team members alike.

Travel : There may be a requirement to travel occasionally in India for this role.
