Legal Manager - Banking (5-7 yrs)

- Minimum Five to Four Years of experience in legal matters including 2 Years in Banking and Finance Companies and two Years as an Advocate

- Graduate/Post graduate degree in Law .

- Profound knowledge of Types of Mortgage, Process of Mortgage, Due Diligence of Mortgage, Lease, Creation of charge over asset , title search, Registration Act, Transfer of Property Act, Contract Act, Specific Relief Act, Civil Procedure Code and Arbitration and Conciliation Act.

- Proficiency in preparing drafts for legal cases, loan documents , briefs, giving opinions on various issue

- Capability of forming strategies & advising on Debt Recovery in Home Loan and Home Equity Products,

- Ability in handling High Court, District Court, DRT & Securitization Cases,NCL & GCL Recovery, Consumer Forum, Criminal , Arbitration cases and HNI customer cases

- Proficient in scrutinizing, inspecting and guiding in all legal matters with effective communication, leadership & problem solving skills.

Job Role :

Legal Planning

- Handling all legal matter/ practices to secure the best interests of the organization in Debt Recovery.

Render

- Advise for Title clearance, Charge in matters of Home Loan

- Advise for planning the strategies and procedures to be followed in Debt Recovery , Maintaining and preparing of Legal MIS for region, RBI MIS and providing quarterly reports on Legal recovery.

- Legal opinion / advice on debt Recovery, Arbitration, , Negotiable Instruments Act ,Civil matters and Criminal matters, execution of warrants.

- Drafting Section 9 application, Arbitration Claim Petition, Suit for redemption of Mortgage

- Attending Arbitration, Section 9, Execution, Court Receiver Meetings, Court Receiver Execution.

- Brief Company’s Counsel on various cases & planning the strategies/ procedures to be followed.

- Conducting / appearing in adjudication, Lok Adalat, Conciliation and inquiry proceedings before various authorities.

Legal Documentation :

- Prepare documentation and handle correspondence & routine legal matters with internal & external customers related to service issues.

- Actively involved in drafting & scrutinizing numerous legal documents such as plaints, written statements, affidavits, petitions, writ & original applications, deeds, agreements, contracts, bonds, guarantees etc.

- Trial preparation, Evidence filling, case development, Arbitration matters and other Alternate dispute resolution matters like Lok- Adalat, Conciliation.

- Handling Arbitration for PAN India from Mumbai

Deliverables:KRA

- Filling cases in Court U/S138, Section 9 for appointment of receiver for custody of assets and other interim measures in Home Loan

- Filling of cases under Negotiable Instruments Act, Payments and Settlement act ,IPC against the Delinquent customers

- Representing Consumer litigation, Criminal Cases, Police matters against the Company in critical cases through Advocates.

- Creating and Developing Legal infrastructure and on line legal system

- Attending Legal matters before various authorities for HNI and individually managing Critical cases

- Review delinquent accounts with Branch Managers and Collection Managers for effective collection and resolution through Legal

- Updating Seniors and Business with respect to recovery through Legal

- NPA and Legal Recovery. Responsible for sale of asset/Properties which are taken into possesion

- Legal training to team members and vendors

- MIS generation and preparation, cost analysis report for Superiors and Business Heads.

- Drafting, vetting of Letters and replies to Customers. R.B.I Ombudsman, various statutory authorities.

- Managing and developing panel of Lawyers across the region

- Drafting, vetting and Preparation and maintenance Legal Documents/Contracts
