The primary function of this function is to follow designed processes, implement and manage perfectly the laid down procedures across the organization in relation to Non - Collection Litigations, rural collections litigations, replying to legal notices, drafting and review of documents/agreements, prompt filing of appropriate applications/proceedings to protect the interest of the institution, liasoning with Police or other enforcement agencies, process and administration management and to attend to matters initiated by them and generate detailed MIS.

Key Performance Indicators:-

- Initiate and manage litigations and proceedings to recover outstanding dues in select rural loan portfolio as per the litigation strategy devised for rural department from time to time

- Manage and monitor Non-Collection litigations

- Choose appropriate legal action to protect the interest of the institution

- Drafting, review and approval of Documents

- Manage cost of litigations and proceedings

- Create & implement an analytics framework to enhance ability to mitigate and manage litigations, reduce tat for replying to legal notices

- Process and product review from time to time and managing administrative matters of legal department

- MIS management

- Audit queries

- Clarifying customer queries raised thru notices by replying in time and explaining him the consequences of default

- Provide support on any action or issued faced by branch officials with Police, regulatory or statutory authorities

- Providing support to Non-collection litigation related issues

- Implement rural collection and litigation strategy

- Build strong relationship with regulatory, statutory, police, enforcement agencies & vendors

- Build capability at branch level to deal with Non - Collection related litigations

- Improve ability to manage Non-Collection related litigations

- Implement a process management & improvement framework

- Ensure adherence to culture with focus on Integrity, Discipline, Teamwork (no silos) & Care

- Ensure strong corporate governance, regulatory compliance & adherence to management model

Task performed

To contest Non-Collection related cases filed against company & to Initiate cases against such persons/entities as deemed appropriate by Head Legal/Management

Initiate and manage litigations and proceedings to recover outstanding dues in select rural loan portfolio as per the litigation strategy devised for rural department from time to time

To reply customer/advocate notices/ queries and resolving the same

To extend support to branches when ever situation demanded in co-ordination with Head Office, Branch and Local Advocates.

To Extend support and in turn protect our employees from harassment from customers and police in false cases. Ensure all support to the possible extent in issuance of notices to customers which were reported as litigant customers by branches.

Ensure that advocates are empanelled after due review

Ensure proper maintenance of MIS and timely report of MIS on all Legal Cases to Head Office and Regional Team

To see that policy laid for Non - Collection related cases and rural collection strategy is fully implemented

Expertise required/ Domain Knowledge:

Collection and Litigation experience in Banking/NBFC sector with core competence in arbitration proceedings, Lok Adalath proceedings, criminal/civil proceedings and proceedings initiated under Negotiable Instruments Act/SARFAESI
