Job Specification:
- Reviewing consumer complaints and notices and vetting replies to notices.
- Advising the regulatory team and the customer operations team on Consumer grievances and impact from a litigation perspective.
- Engaging external lawyers and briefing and reviewing Industry Policies, Regulations and advising business functions.
- Strategizing and filing challenges before the appropriate forums including Telecom Disputes Settlement and Appellate Tribunal, High Courts and the Supreme Court.
- Advising the tax team on internal policy decisions and laying down exposures on the litigation front.
- Handling tax litigation before the High Courts and the Supreme Court relating to Value Added Tax, Customs and Excise, Entertainment Tax, Entry Tax, Goods & Services Tax (to come into effect from 01 July 2017).
- Reviewing and finalizing all pleadings including applications, replies, petitions, plaints, written statement, replications, rejoinders to be filed before the Courts, Tribunals & Arbitration proceedings.
- All consequential and incidental activities related to court proceedings, including coordinating with external lawyers and briefing Senior Counsels.
- Advising on Labour law issues, HR policies and third party engagements including Contract Labour Regulation Act, Minimum Wages Act, Employees Provident Fund Act, Payment of Bonus Act.
- Providing support to business on risks and exposure from a litigation perspective.
- Regularly following up on Industry litigation and advising and updating the company on changes and developments based on court precedents.
- Initiating appropriate proceedings for and on behalf of the Company and defending the company in cases filed before the various courts, tribunals and quasi-judicial bodies including civil and criminal proceedings and matters related to the Broadcast Industry before the Telecom Disputes and Settlement Appellate Tribunal.
